1. The Zen in your Eyes】 2016 ASUS ZenFone Photography Awards (“Promotion”) is sponsored and hosted by ASUSTeK Computer Inc. (“ASUS”) and presented by Qualcomm Technologies, Inc. (“Qualcomm”), the sponsor of the Prize Draw.
2. Detailed information with respect to how to participate and win prizes in connection with this specific Promotion, ASUS Terms of Use Notice, ASUS Privacy Policy and ZenTalk Forum Terms & Conditions on ASUS official website located at ___________.com.
3. The Promotion will begin on 12th, July, 2016 at 12:00am (UTC+8:00) and close on 10th, October, 2016 at 11:59pm (UTC+0:800) (“Promotion Period”) globally.
4. Participation constitutes a Participant’s acceptance of these Prize Draw Terms and Conditions. ASUS may at any time revise the Promotion Terms and Conditions and other rules set forth by ASUS. By participating in the Promotion, Participants represent and warrant meeting the eligibility requirements and acknowledge that failure to meet all eligibility requirements stated in the Promotion Terms and Conditions will result in disqualification in the Promotion and the Prize Draw (“Prize Draw”) if Participant is determined a Finalist.
5. Employees (and their immediate families [spouse, parent, child, sibling and their respective spouses], regardless of where they reside or those living in the same households, whether or not related) of ASUS, Qualcomm, Ventura Associates International LLC (the “Administrator”), and their respective parent companies, affiliates, subsidiaries, prize supplier(s), content provider partners, competitors, distributors advertising and promotion agencies, or any individual of a local and/or national government organization, entity and/or agency are not eligible to enter or win. Subject to all national, territorial and local laws and regulations. No responsibility can be accepted for entries which are not properly received due to communications beyond ASUS' control. ASUS reserves the right to disqualify any and all entries tied back to any Participant using multiple email addresses or under multiple identities. ASUS is not responsible for and will not be liable for Entries that are late, lost, incomplete, illegible, misdirected, disqualified or contain errors. All Entries submitted become property of ASUS and will not be returned or acknowledged. ASUS, Qualcomm and/or the Administrator will not assume responsibility for any third party’s failure to act in accordance with its instructions pertaining to the implementation of the Promotion and the Prize Draw.
6. The Prize Draw is solely opened to any Participant declared a Finalist. All eligible Participants who advanced and who at ASUS’ sole discretion are confirmed as a Finalist in the Promotion will be automatically placed in the Prize Draw for the opportunity to be part of the Qualcomm Photo Tour (“Prize”). Four (4) potential winners will be randomly selected on or about November 22, 2016 from the pool of eligible Participants. Prize Draw will be conducted by ASUS. Potential winners will be notified within seven (7) days of the prize draw taking place via email from ASUS or ASUS’ designated agent.
7. Potential Prize Draw winners must sign and return a declaration of eligibility/publicity release (“Affidavit”) and agree to disclose such affiliations to Qualcomm within ten (10) business days of notification. If a potential winner does not reply and/or return the executed Affidavit within ten (10) business days, or if notification email is returned as undeliverable, or if the potential winner is otherwise found to be ineligible, or if the potential winner cannot accept or receive the Prize for any reason or If the potential winner cannot be contacted within seven (7) business days, the potential winner will forfeit all rights to the corresponding Prize and an alternate winner may be randomly drawn from the remaining pool of eligible Participants by ASUS.
8. Each winner will receive Prize consisting of: Roundtrip coach air transportation for winner (only) from Taipei, Taiwan to San Diego, California, United States, 4 nights/5 days hotel accommodations (standard single occupancy, room and room tax), ground transfers and local transportation, meals and schedule of events including a tour of Qualcomm headquarters and escorted excursions to two (2)other attractions such as the San Diego Zoo, tour of beaches, , Sea World, and/or a shopping tour, plus select service charges, gratuities to local guides, admission fees, taxes and porterages while in San Diego. Total Approximate Retail Value (“ARV”) of each prize: $2,500.00. All prize values are in US currency. If actual value of Prize is less than the stated ARV, the difference will not be awarded.
9. Winners will be responsible for obtaining travel visas and passports necessary for international travel, and are responsible for all arrangements and expenses for arrival at the specified Taipei airport. Winners must travel on dates specified by the Promoter or will forfeit all portions of the prize. Travel is tentatively scheduled to take place between April 1, 2017 and May 31, 2017. All Prize details are at Qualcomm sole discretion. Prizes are non-transferable and no substitution by any winner is allowed, and cannot be liquidated unless decided otherwise by the Qualcomm in its sole discretion and its decisions related to the awarding of any prize are final.
10. The names of the winners, country winner originates from and Prize won will be announced on ZenTalk on or about November 22, 2016 by ASUS.
11. In the eventuality the Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or any Force Majeure event(s) has destroyed or severely undermined or impaired the integrity and/or feasibility of the Promotion, ASUS reserves the rights to cancel, terminate, make changes, or suspend this Promotion without notice, as well as the rights of final definition. All changes will be announced on ZenTalk. Promotion is void where restricted and/or prohibited by law.
12. Winning constitutes permission (except where prohibited by law) for ASUS and/or Qualcomm to use each winner’s name, photograph, hometown, likeness, and prize won (all at Sponsor’s discretion), including any video/film produced during winner’s visit to San Diego for future advertising, publicity in any and all media now or hereafter devised throughout the world in perpetuity, without additional compensation, notification, release, or permission. By participating in the Promotion, Participants (i) agree to be bound by these Terms and Conditions, including all eligibility requirements, and (ii) agree to be bound by the decisions of ASUS, which are final and binding in all matters relating to the Promotion. Failure to comply with these Terms and Conditions may result in disqualification from the Promotion. ASUS reserves the right to permanently disqualify any Participant it believes has intentionally violated these Terms and Conditions.
13. By participating in the Promotion, Participant agree to release and hold harmless ASUS and Qualcomm from all claims, liability or damage caused or claimed to be caused, in whole or in part, directly or indirectly, in connection with participation in the Promotion, and/or acceptance or use of any prize awarded, the substitution of any prize in accordance with these Terms and Conditions, the administration of the Promotion, an Participant’s breach of Terms and Conditions or ASUS’ and/or Qualcomm’s use of any of the rights granted herein. Any and all disputes, claims, and causes of action arising out of or in connection with this Prize Draw, shall be resolved individually, without resort to any form of class action. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH PARTICIPATING. PARTICPANTS HEREBY WAIVE ANY RIGHTS OR CLAIMS TO LEGAL FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF PARTICPANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
14. Information collected from any Participant is subject to ASUS’ Privacy Policy located at: https://www.asus.com/Terms_of_Us ... erms_of_Use_Notice. The information Promoter collects is stored and processed on servers in Taiwan. Participation in the Promotion constitutes permission and authorization to collect, process and use the data provided concerning the Participant and to transfer such personal data to Taiwan for purposes of management of the Promotion and future offers for any Participant that has opted-in to receive such offers.
